1. Acceptance of Terms and Conditions
   YOU MUST READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ENTERING THIS WEBSITE
   1. By clicking on the "I accept" button on the registration form, you signify your irrevocable acceptance and agreement to these terms and conditions with Dream Creations International CC t/a Lifestyle Dynamics.
   2. Lifestyle Dynamics may amend, revise and/or update these terms and conditions at any time. By continuing to use the website, you indicate your agreement to such amendments.

2. About Lifestyle Dynamics
   1. Lifestyle Dynamics' offering promotes a philosophy of wellness through lifestyle management, focusing on three niche sectors:
      • Health & Wellness
      • Personal Aesthetics
      • Sport & Fitness
   2. Our database provides access to lifestyle products and services offered by an exclusive portfolio of Service Providers. Lifestyle Dynamics collates, assimilates and filters information on behalf of carefully selected Services Providers, and then facilitates access, through its website, to that information.
3. Membership, Payment and Delivery Policy
   1. Subject to receipt of your membership payment, on-line applications for memberships will be processed within seven days, thereupon your user name and password will be transmitted to you via your designated e-mail address and your member's card and coupon booklet forwarded to you at the address designated in your on-line registration.
   2. Your member's card is valid for 1 year from date of issue and entitles you to certain discounts and benefits when presented at selected Service Providers. Your member's card can be replaced, if lost, at a cost of R120-00 including VAT to the relevant member.
   3. Your membership may be renewed annually by following the renewal procedures on our website and by payment of the annual membership fee. Should you not follow the designated renewal procedure or fail to pay the annual membership fee, your membership shall automatically terminate and you will have no recourse of whatsoever nature against us in this regard.
4. Payment Options
   Payment may be made online via Visa, Mastercard, Diner's or American Express credit cards or by bank transfer into our bank account, the details of which will be provided on request.
5. Return and Refunds Policy
   You are not entitled to a refund of your membership fee at any time or for any reason whatsoever.
6. Customer Privacy Policy
   Lifestyle Dynamics shall take all reasonable steps to protect the personal information of members. For the purpose of this clause, personal information shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from www.polity.org.za/html/govdocs/legislation/2000/act2.pdf.
7. Credit Card Acquiring and Security
   Credit card transactions will be acquired for Lifestyle Dynamics by PayGate (Pty) Ltd, who are the approved payment gateway for Standard Bank of South Africa. PayGate use SSL3 and no credit card details are stored on the website. Members may go to www.paygate.co.za to view their security certificate and security policy.
8. Member Details separate from Card Details
   Member details will be stored by Lifestyle Dynamics separately from card details which are entered by the member on PayGate's secure site. For more detail on PayGate, refer to www.paygate.co.za.
9. Merchant Outlet Country and Transaction Currency
   The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. The transaction currency is ZAR (South African Rand).
10. Country of Domicile
    This website is governed by the laws of South Africa and Lifestyle Dynamics chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, 13 Buitengracht Street, Cape Town, South Africa.
11. Variation
    Lifestyle Dynamics may, in its sole discretion, change this agreement or the membership fees it charges or any part thereof at any time without notice.

14. Use of Coupons
    The specific terms and conditions relating to the use of the coupons issued to you upon payment of your annual membership fee are as follows :
    1. Coupons may not be exchanged for cash.
    2. Only one coupon may be used per purchase, class, consultation or session.
    3. Defaced coupons will be rendered null and void.
    4. This coupon is only redeemable at the participating Service Providers of Lifestyle Dynamics.
    5. Special offers only apply on presentation of the original coupon which must be handed in at the relevant Service Provider.
    6. The barter, exchange, trade, sale, purchase or transfer for any compensation, monetary or otherwise, other than in relation to a transaction with a participating Service Provider for Lifestyle Dynamics, is strictly prohibited.
    7. Coupons may not be copied or reproduced in any way whatsoever.
    8. Lifestyle Dynamics may not be responsible or liable in any way whatsoever, for damages, monetary loss or otherwise, should any Service Provider fail or refuse to accept a coupon or adhere to the special offers, discounts and prices reflected thereon, nor shall Lifestyle Dynamics be held liable for any act or omission of whatsoever nature and howsoever arising, whether by negligence or otherwise, and whether committed by it, its agents, employees or Service Providers and you, as user of this coupon hereby indemnifies and holds Lifestyle Dynamics harmless for any liability in this regard, of whatsoever nature and howsoever arising.
15. Information on Website, Exclusion of Liability and Indemnity
    
    1. The information contained in this website is general in nature and is intended solely as a mechanism to provide you with access to a database of Service Providers in the lifestyle and wellness management industry and as listed in the designated categories on the website.
    2. This information does not mean that Lifestyle Dynamics recommends one Service Provider over any other, or that it recommends these Service Providers over any others who are not listed on its website.
    3. This information is not intended to substitute the expertise and judgment or recommendation of your physician, pharmacist, healthcare professional or any other person offering services similar to the listed Service Providers. You are at all times advised to make decisions regarding your wellness and lifestyle management in consultation with the appropriate professional.
    4. Lifestyle Dynamics shall not be responsible nor be held liable in any way whatsoever for any loss or damage of whatsoever nature and howsoever arising and occasioned by the use of the information presented on this website or from your use of the services of any Service Provider listed on this website.
    5. Lifestyle Dynamics, its owning Member, employees, agents and/or members are not responsible for any decisions you may make resulting from the use of the information on this website.
    6. Lifestyle Dynamics shall not be liable for any loss or damage suffered by you of whatsoever nature or howsoever arising resulting from any act or omission of Lifestyle Dynamics, its owning Member, employees, agents and/or members, the Service Providers, including but not limited to, negligence, wilful conduct or misconduct.

You hereby indemnify and hold Lifestyle Dynamics, its owning Member, employees, agents and/or members, harmless against all loss or damages suffered or sustained by you, actual or contingent, including, without limitation, any direct, indirect, special, incidental, consequential or punitive damages, including damages for loss of profits, loss of business or downtime, whether in an action arising out of contract, statute, or otherwise arising out of or relating to the use of, or inability to use, this website, the information contained therein or the services of the Service Providers.
    8. You accordingly agree that your use of this website is entirely at your own risk.
    9. Lifestyle Dynamics does not warrant the accuracy of data or information contained in this website. Although all reasonable efforts have been made to ensure that information is accurate and up-to-date.

17. Use of Site

Lifestyle Dynamics merely provides you with a platform for obtaining the information contained in this website and has no control whatsoever over the legality of coupons issued or other offers made by Service Providers, the ability of any of the Service Providers to complete transactions in accordance with the coupons or other offers made, or the quality of goods or services offered and provided by the Service Providers.
    2. Lifestyle Dynamics has no control over whether Service Providers will honour the offers contained on coupons or made on this site and does not guarantee or warrant the accuracy or completion of the information contained in this website.
    3. In the event that you have any claim of whatsoever nature and howsoever arising against any Service Provider, you hereby waive and indemnify Lifestyle Dynamics from all claims of whatsoever nature and howsoever arising relating to that dispute.
18. Review of Postings and Uploads
    
    1. Lifestyle Dynamics does not and cannot review all communications and material posted or uploaded to this website and is not responsible for the content of these communications and materials.
    2. However, Lifestyle Dynamics reserves the right to block or remove communications or materials posted on this website that it determines, in its sole discretion to be :

       • fraudulent, deceptive or misleading;

19. Online Forum
    
    1. Your participation in our online forum is not edited, censored or otherwise controlled by Lifestyle Dynamics and we cannot and do not screen content which you or other users provide or upload. Lifestyle Dynamics does however reserve the right to monitor and remove content which it, in its sole opinion, deems to be harmful, offensive or in violation of these terms and conditions.
    2. You may send and receive electronic mail and engage in our forum by means of conferences and/or chat rooms. Your activities in conferences and/or online forums are however subject to review, modification and deletion without notice by Lifestyle Dynamics.
    3. You are responsible for your communications and use of our website. You may not under any circumstances do or cause to be done anything which constitutes unlawful conduct.
20. Availability of Service
    
    1. Lifestyle Dynamics shall make every effort to make the service available at all times and shall use its utmost endeavours to strive for 100% uptime. Lifestyle Dynamics is, however, unable to guarantee 100% uptime.
    2. You accordingly indemnify Lifestyle Dynamics against all claims of whatsoever nature and whether foreseeable or unforeseeable, as a result of Lifestyle Dynamics being unable to make its service available to you under any circumstances.
    3. Lifestyle Dynamics will provide access to this site and the service strictly subject to the terms and conditions prescribed by any competent regulatory authority.
21. User Etiquette
    You acknowledge and agree that :
    1. You are expected to abide to generally accepted etiquette.
    2. You shall not use the service in a manner which:
       • constitutes a violation of any law, regulation or tariff that may be offensive to internet users in general, to the public at large or as same may be determined from time to time by Lifestyle Dynamics in its sole discretion, specifically including, but not limited to, the hosting of pornographic material, spamming, hacking and unsolicited mailing;

       • tends to damage the name or reputation of Lifestyle Dynamics, its affiliates or subsidiaries; or interferes with the use and enjoyment of internet related services of members of Lifestyle Dynamics.
    3. You undertake to abide by all laws applicable to copyright, re-distribution or re-sale of any data and/or information retrieved from the site and/or the internet as specified or implied by Lifestyle Dynamics or any of the local or foreign Service Providers or laws governing the provisions of the service and the internet.
22. Termination
    
    1. Your membership is renewable on an annual basis and will immediately terminate after expiry of a period of one year from date of issue of your membership card and booklet of coupons, unless renewed annually 30 days before said expiry date by means of payment of your annual membership fee.
    2. Your membership may be terminated in our entire discretion should you be found to be in violation of the provisions of these terms and conditions.
